Since 2006, people moving abroad permanently from the UK, either to work or retire, have been able to transfer their UK registered pension overseas with them to a suitable qualifying overseas recognised pension scheme (QROPS). Once you have been a non-UK resident for 5 consecutive tax years, depending on your circumstances, there could be advantages transferring to a QROPS pension for retirement planning purposes

OVERSEAS TRANSFER ALLOWANCE
In 2024, the UK removed the lifetime allowance, which previously limited the amount of pension benefits that could be accessed from UK-registered pension schemes without triggering a tax charge. It was replaced by the overseas transfer allowance (OTA).
The OTA is currently set at £1,073,100. If UK pension benefits are transferred to a QROPS above this amount, a 25% tax charge applies to the excess at the point of transfer.
For individuals with pension funds close to, or expected to exceed, the overseas transfer allowance, transferring UK pension benefits to a QROPS may form part of a wider retirement planning strategy. Once benefits have been transferred to a Gibraltar QROPS, the value of those funds can continue to grow without
being subject to further overseas transfer allowance charges.
Whether a transfer is appropriate depends on personal circumstances, tax residency and long-term retirement objectives, and should always be assessed with regulated financial advice.
DEATH BENEFITS
From April 2027, UK pension benefits are expected to form part of an individual’s estate for UK Inheritance Tax purposes. When an individual leaves the UK, their worldwide estate can remain within the scope of UK Inheritance Tax for up to 10 years following their departure.
After these 10 years, UK situs assets remain subject to UK Inheritance Tax. This can include UK-based pension arrangements. As a result, long-term estate planning becomes an important consideration for individuals who have left the UK permanently.
For individuals who have been, or expect to be, non-UK residents for more than 10 years, transferring UK pension benefits to a Gibraltar QROPS may form part of an inheritance tax planning strategy. In appropriate circumstances, and provided the individual does not return to UK residence, benefits held within a Gibraltar QROPS may fall outside the UK Inheritance Tax estate.
The suitability of a UK pension transfer depends on an individual’s residency status, residency history and long-term intentions, and should always be reviewed with regulated financial advice.
PENSION BENEFITS
Once you have been a non-UK resident for 10 consecutive tax years and reached the age of 55, a Gibraltar QROPS can pay 30% of the pension fund as a pension commencement lump sum (tax free) compared to the 25% tax free lump sum that is normally provided with UK pension plans. The rest of the fund must be retained to provide an income for life.
A key advantage of taking an income from a Gibraltar QROPS is that the income payments only attract a 2.5% tax rate.
SAFEGUARDED BENEFITS
Safeguarded benefits include defined benefits, guaranteed minimum pensions and guaranteed annuity rates. If a member has safeguarded benefits worth more than £30,000, they must receive regulated advice from a UK financial adviser before transferring those funds. This requirement includes overseas transfers, where the member is also likely to need advice from an overseas based financial adviser in respect of the other country’s pension and tax regime.
QROPS RULES
In order to be a QROPS, an overseas pension scheme must first be a recognised overseas pension scheme (ROPS). An overseas transfer is only an authorised payment if the receiving overseas scheme is a QROPS as at the date of the transfer.
If you transfer to an overseas pension that is not a QROPS on the transfer date, the payment becomes unauthorised. Resulting in it being subject to a 40% unauthorised payment charge and possibly also a 15% unauthorised payment surcharge and a scheme sanction charge. HMRC publishes a ROPS list, warning that the member is responsible for establishing whether an overseas pension scheme is a QROPS before transferring.
To become a QROPS, all the following must apply:
The scheme must self-certify to HMRC that it is a recognised overseas pension scheme.
HMRC must not have excluded it from being a QROPS.
It must undertake to report certain details on UK tax relieved pension funds and inform HMRC if it ceases to be a QROPS.
UK tax charges can still apply for a period after transferring to a QROPS. Unauthorised member payment tax charges can apply if certain investment and benefit restrictions are breached. A 25% overseas transfer charge will also apply on transfers to QROPS that do not meet one of the exemptions specified by HMRC. A member must be tax resident in the same country as the one in which the QROPS is established. Gibraltar happens to be one of the few jurisdictions that meets this requirement and therefore is exempt of overseas transfer charges. This is a huge benefit to UK nationals considering moving to Gibraltar from UK.
Why Gibraltar for QROPS?
Gibraltar’s transparent regulation, low 2.5% tax rate and proximity to the UK make it one of the safest and most flexible jurisdictions for managing overseas pension schemes.
INVESTMENT
Gibraltar QROPS typically operate on an open-architecture basis, allowing advisers to recommend a broad range of regulated and suitable investments. Depending on the provider, members may access options such as exchange-traded funds (ETFs), collective investment funds, managed portfolios and other mainstream securities.
Each QROPS provider has its own permitted investment list, and some products place restrictions on alternative or illiquid assets. Direct investment into physical commodities, including physical gold, is not always allowed and must be checked with the scheme provider in advance.
A flexible investment menu means your pension can be aligned to your risk profile and long-term retirement goals, making it one of the most effective Gibraltar pensions for UK expats.
Gibraltar pension providers are regulated by the Gibraltar Financial Services Commission.
GIBRALTAR
Financial services in Gibraltar are regulated and licensed by the Gibraltar Financial Services Commission. Pension scheme operators in Gibraltar must obtain a pension scheme controller license to offer QROPS. Under the conditions of the license, Gibraltar QROPS providers must take steps to protect their members. For example, they must ensure the member has received appropriate financial advice from a regulated financial adviser. They must also treat members as retail investors and take sufficient steps to protect them from high-risk non-retail investments.

Frequently Asked Questions About QROPS and Overseas Pensions
Can I transfer my pension overseas to Gibraltar?
Yes, if you have a UK registered pension scheme, you may be eligible to transfer your UK pension overseas to Gibraltar through a Qualifying Recognised Overseas Pension Scheme (QROPS). This allows you to benefit from Gibraltar’s favourable tax regime, increased investment flexibility and  simplified estate planning.
What is the Overseas Transfer Allowance (OTA) and how does it apply?
The Overseas Transfer Allowance (OTA) sets a limit on the total amount of pension funds you can transfer to an overseas pension scheme without incurring extra tax charges. If the value of your UK pension exceeds this allowance, additional taxes may apply. This makes careful tax and retirement planning essential before transferring to a Gibraltar QROPS.
How long do I have to complete a pension transfer once I start the process?
When you begin the paperwork for transferring to a Qualifying Recognised Overseas Pension Scheme (QROPS), most providers require the transfer to be finalised within 60 days of receiving the necessary documentation. Delays can cause compliance issues, so working with experienced advisers helps ensure the process runs smoothly.
What is the Overseas Transfer Charge (OTC) and when does it apply?
The Overseas Transfer Charge is a 25% tax that can apply when UK pension benefits are transferred to a QROPS. It generally applies unless both the individual and the QROPS are tax residents in the same country at the time of transfer. If this condition is not met, the charge may apply to the amount transferred. Gibraltar meets these conditions and is therefore exempt.
Can I transfer my UK registered pension scheme to a recognised overseas pension scheme?
Yes. A UK registered pension scheme can often be moved to a recognised overseas pension scheme, such as a Qualifying Recognised Overseas Pension (QROPS). The scheme administrator must check HM Revenue & Customs (HMRC) rules to confirm it is a recognised UK pension transfer. The transferred value is tested against the overseas transfer allowance and depending on your pension savings, a tax charge or overseas transfer charge applies. Careful tax planning ensures you maximise pension benefits while avoiding unnecessary tax penalties.
Why should I consider a transfer to a Gibraltar QROPS if I want to retire abroad?
If you plan to retire to Gibraltar, a QROPS transfer may provide key tax advantages. Unlike keeping your pension funds in a UK pension provider, transferring to a QROPS may offer more flexible investment options, a higher lump sum allowance and  potentially reduced uk tax under a double taxation agreement. This can be attractive if you expect your pension income to be taxed under different rules once you leave the UK. You can also remain invested in global assets and adapt your investment strategy to your retirement goals. The qrops scheme manager ensures compliance with HMRC, protecting you from unintended tax implications during the relevant period after transfer.
What happens if I mistakenly transfer to a non QROPS scheme?
Transferring to a non QROPS scheme is considered unauthorised for tax purposes. This mistake can be expensive, as HMRC treats the transfer as unauthorised. HMRC may impose a tax charge of up to 55% of the transferred value, plus potential tax penalties. Only a receiving pension scheme listed as a QROPS by HM Revenue is eligible. Always confirm the receiving pension scheme status before you transfer funds and  work with financial advisers familiar with registered pension schemes to avoid costly mistakes.
Can I take a lump sum from an overseas pension scheme?
Yes. Once you reach the minimum pension age, a QROPS may allow a higher lump sum than many UK pension schemes. Some Gibraltar QROPS, for example, offer a 30% pension commencement lump sum allowance, compared with the 25% standard in many UK registered pensions. The balance must be used to provide pension income, but the overall pension benefits and potential death benefit allowance are often more favourable when you hold your pension overseas.
